PAULS KIDS BLUEY PROMOTION

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Entry in this promotion is deemed acceptance of these Terms and Conditions.
  2. The promoter is Lactalis Australia Pty Ltd ABN 56 072 928 879 of 35 Boundary St South Brisbane, Qld 4101 telephone 1800 676 961 (Promoter).
  3. Entry in the promotion is only open to Australian residents.
  4. Individuals under 18 years old must have parental/guardian approval to be eligible to enter or to claim a prize and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 
  6. The promotion commences at 9.00am AEDST on Tuesday 19 January 2021 and ends at 11:59pm AEDST on Tuesday, 26 January 2021 (“Promotional Period”).
  7. To enter, an entrant must, during the Promotional Period, in the Pauls Kids Bluey Promotion post on the Pauls Facebook page, upload a picture of their child eating/holding one of our Pauls Kids Bluey yoghurt or custard products and tell us their favourite Bluey character, in the comment section of the post using the #paulskidsfan
  8. Entries must be received by the Promoter on its Pauls Facebook page during the Promotion Period.
  9. All winners will be announced via the Pauls Facebook page at 12.00pm AEDST on Wednesday, 27 January 2021.
  10. Each entrant warrants to the Promoter that the entry they submit is an original creative work of the entrant that does not infringe on the rights of any third party. The content featured in each entry must comply with the provisions contained in clause 27.
  11. Judging will take place at the office of Lactalis Australia Pty Ltd ABN 56 072 928 879 of 35 Boundary St South Brisbane, Qld 4101 at 10am AEDST on Wednesday, 27 January 2021.
  12. All entries are subject to review by the Promoter or its agents for compliance with these Terms and Conditions. Entries and any related posts on Facebook or other social media must not contain prohibited, illegal or inappropriate content. Any person who submits such content will have their post(s) taken down and they will not be eligible to win a prize.
  13. Incomplete or indecipherable entries will be deemed invalid.
  14. Entrants may submit as many entries as they wish but no entrant may win more than one (1) prize.
  15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual whom the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  16. If there is a dispute as to the identity of an entrant the Promoter reserves the right, in its sole discretion, to determine the identity of the relevant individual.
  17. This is a game of skill and chance plays no part in determining the winners.  Each entry will be individually judged based on the originality, literary merit and creative merit of the entry provided in response to the promotional request.
  18. Each entry will be individually judged in the absolute discretion of the Promoter and the Promoter will select 10 winners to win a prize from the entries submitted on the Pauls Kids Bluey promo Facebook posts during the Promotion Period, entries must use the hashtag #paulskidsfan when submitting their entry (there will be a total of 2 posts on Facebook).
  19. The Promoter’s decision is final and no correspondence will be entered into.
  20. Each prize comprises:
    • a. Pauls Bluey Stuck on You Lunch Bag & Bento lunch box = $84.95
    • b. Pauls Bluey Stuck On You Water Bottle = $24.95
    • c. Bluey backpack = $25
    • d. Bluey Book = $10

Each prize pack is valued at approximately $144.90 including GST (recommended retail price).

  1. Total prize pool valued at approximately $1,449 including GST (recommended retail price)
  2. The Promoter will (or will arrange for its agent to) contact the winners via a private Facebook message and to notify them that they have won a prize, verify their identity and ascertain delivery details.
  3. To accept the prize, a winner (or their parent/guardian if the winner is under the age of 18 years) must provide their full name, phone number and delivery address to the Promoter or its agent which the Promoter or its agent may then provide it to any third party distributor or courier for the purpose of arranging delivery of the prize to a winner (or their parent/guardian if the winner is under the age of 18 years) at their nominated delivery address.  The Promoter or its agent will arrange for delivery of a prize to a winner as soon as practicable after that winner provides their or their parent/guardian’s full name, phone number and delivery address to the Promoter or its agent pursuant to this clause, however, it may take up to 72 hours after receipt of those details by the Promoter or its agent for a prize to be dispatched to a winner.
  4. In the event of a winner not claiming within 1 day after a private Facebook message being sent to the winner by the Promoter or its agent notifying of the win, the prize will be forfeited and the Promoter reserves the right to distribute the prize to the next best valid entry that has not already received a prize.
  5. If a prize, or element of a prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it.
  6. The prizes are not transferable or exchangeable and cannot be taken as cash.
  7. Entrants are fully responsible for any materials they submit in relation to the promotion including but not limited to comments on Facebook and photographs (Content). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Each entrant:
    • a. must not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic,
    • b. sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    • c. must ensure that their Content does not contain viruses or cause injury or harm to any person or entity;
    • d. must obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    • e. must ensure that the Content is the original work of the entrant and that it does not infringe the rights of any third party;
    • f. consents to any use of the Content which may otherwise infringe the Content creator’s moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    • g. must comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
  8. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of any entrant’s comment posted on Facebook or other social media.
  9. As a condition of entering and participating in this promotion, each entrant licenses and grants the Promoter, its related bodies corporates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the entry and any photograph that the entrant provides to the Promoter, and any other Content, for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  10. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entry; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  12. Any cost associated with accessing the promotion is the entrant’s responsibility and is dependent on the internet service provider used.
  13. The Promoter assumes no responsibility for:
    • a. any incorrect or incomplete information which may be communicated in the course of the administering this promotion; or
    • b. any delay in delivery (when not directly caused by the Promoter) or failure of safe delivery of a prize.
  14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising out of:
    • a. the promotion;
    • b. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    • c. any theft, unauthorised access or third party interference;
    • d. any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    • e. any variation in prize value to that stated in these Terms and Conditions; or
    • f. taking and/or use of a prize;  or
    • g. any taxation implications that may arise from winning of a prize.
  16. The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and, as required, to Australian regulatory authorities. Entry in this promotion is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://lactalis.com.au/wp-content/uploads/2019/09/LE-001-01-Privacy-Policy.pdf. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrants. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
  17. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities (which can be viewed at facebook.com/terms.php. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
